By accessing and using TranslateLive, you agree to the following Terms of Use. If you do not agree with any part of these terms, please refrain from using the service.
1.1. These Terms of Use (hereinafter – "Terms") govern the relationship between SoulDestiny (hereinafter – "Company") and any person using the TranslateLive service (hereinafter – "User", "Service").
1.2. Use of the Service constitutes the User's unconditional acceptance of these Terms. If the User does not agree with the Terms, they must immediately cease using the Service.
1.3. These Terms may be amended by the Company unilaterally. Continued use of the Service after the Terms are amended constitutes acceptance of such amendments.
Service – the TranslateLive computer program, including the browser extension, website, and related technologies designed for real-time audio and video translation.
AI (Artificial Intelligence) – machine learning technologies and neural network algorithms used to generate translations.
Paid Subscription – access to the extended functionality of the Service on a prepaid basis.
Free Minutes – time-limited access to the Service for introductory purposes.
3.1. The Company grants the User access to the Service under a simple (non-exclusive) license.
3.2. The Service allows the User to perform real-time translation of audio and video content using AI technologies.
4.1. SoulDestiny is not responsible for: (a) actions taken based on interpretations provided by the service; (b) emotional or psychological reactions to translations; (c) data loss, financial losses, or indirect damages; (d) technical failures or service interruptions.
4.2. To use the Service, the User must register and create an account.
4.3. The User is solely responsible for the security of their credentials and for all actions performed under their account.
4.4. The Company reserves the right to refuse registration without explanation.
5.1. Use of the Service is permitted for persons who have reached the age of 18.
5.2. Persons under 18 may use the Service only with written consent from parents or legal guardians.
5.3. Parents or legal guardians of a minor user: Confirm that they have read and understood these Terms; Consent to the processing of the minor's personal data; Bear full responsibility for the minor's compliance with the Terms; Are responsible for all payments made using the minor's account.
5.4. The Company may request documents from the User confirming age and parental consent. Failure to provide such documents is grounds for account suspension.
6.1. The Service is provided on a paid basis. Free minutes are provided for introductory purposes and may be limited in quantity and validity period.
6.2. The price of the Paid Subscription is stated on the Website and may be changed by the Company unilaterally with mandatory notice to the User 14 (fourteen) calendar days in advance via email and/or publication on the Website.
6.3. Payment is processed through a payment partner. All payments are final and non-refundable, except as expressly required by law.
6.4. The User is responsible for timely payment. Failure to pay will result in suspension of access to the Service.
6.5. The Company reserves the right to change the price, scope, and conditions of Paid Subscriptions at any time.
Most purchases and subscription changes are processed instantly. However, due to technical or payment delays, changes may take up to 48 hours. Please wait this period before contacting support.
8.1. Exclusive rights to the Service, including source code, design, algorithms, and logos, belong to the Company.
8.2. The User is granted the right to use the Service in accordance with its intended purpose. It is prohibited to: a) Copy, modify, decompile, or disassemble the Service; b) Use the Service to create competing products; c) Circumvent the technical restrictions of the Service.
8.3. All rights to content (audio, video) uploaded by the User belong to the User.
9.1. NO ACCURACY GUARANTEES. The Service uses artificial intelligence technologies which, by their nature, may contain errors. The Company DOES NOT GUARANTEE the accuracy, reliability, completeness, timeliness, or suitability of translations for any purpose.
9.2. INFORMATIONAL PURPOSE. Translation results are provided solely for informational purposes and do not constitute professional translation.
9.3. ERROR WARNING. The User is warned and agrees that AI-generated translations may contain: a) Semantic and grammatical errors; b) Inaccuracies in specialized terminology; c) Loss or distortion of context; d) Inappropriate word choices.
9.4. SPECIAL CASES. It is strongly NOT recommended to use the Service for translating: a) Medical documentation; b) Legal documents and contracts; c) Financial statements; d) Documents requiring notarization; e) Other materials where a translation error may cause significant harm.
9.5. USER RESPONSIBILITY. The User independently assesses the suitability of translation results for their purposes and bears all risks associated with the use of AI-generated translations.
9.6. CONTINUOUS IMPROVEMENT. The Company continuously works to improve translation quality; however, the User acknowledges that AI technology has limitations and cannot guarantee 100% accuracy.
10.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
10.2. The Company PROVIDES NO WARRANTIES, express or implied, including but not limited to: a) Warranty of uninterrupted operation; b) Warranty of freedom from errors, failures, or viruses; c) Warranty that the Service meets the User's expectations; d) Warranty of accuracy, reliability, or completeness of results; e) Warranty of data preservation.
11.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR: a) Any direct or indirect damages; b) Loss of profit; c) Data loss; d) Business interruption; e) Reputational harm; f) Any other losses arising from the use or inability to use the Service.
11.2. LIMITATION OF LIABILITY AMOUNT. If a court finds the Company liable for damages, the Company's total liability shall be limited to the amount paid by the User to the Company in the 12 (twelve) months preceding the event giving rise to liability.
11.3. The Company is not responsible for the actions of payment partners, hosting providers, internet service providers, or other third parties.
11.4. The Company is not responsible for the content translated by the User or for the User's compliance with third-party rights when using the Service.
12.1. The Company may suspend or terminate the User's access to the Service at any time without prior notice in the event of: Violation of these Terms; Receipt of complaints from other users or third parties; Government authority requirements; Other circumstances where the Company deems it necessary.
12.2. The Company is not obligated to disclose reasons for suspending access.
12.3. Suspension of access does not release the User from payment obligations and does not limit the Company's right to collect outstanding debts.
12.4. The Company is not liable for any damages arising from the suspension of access.
13.1. The User is prohibited from: Using the Service to translate content that: Violates the law; Contains calls to violence, extremism, or terrorism; Promotes discrimination or hatred; Contains pornography, especially involving minors; Infringes the intellectual property rights of third parties.
13.2. The User is prohibited from: Attempting to gain unauthorized access to the Service, servers, or databases; Using the Service to distribute malware, viruses, or spam; Interfering with the Service's operation or creating excessive server load; Using the Service to collect data about other users without their consent.
13.3. Attempting to circumvent the technical restrictions of the Service.
13.4. Using automated tools (bots, scrapers) to access the Service.
13.5. Disrupting the Service's operation or creating excessive load.
14.1. The User may at any time discontinue use of the Service by deleting their account.
14.2. The Company may terminate this agreement unilaterally at any time with notice to the User.
14.3. Upon termination, paid amounts are non-refundable.
15.1. Personal data processing is carried out in accordance with the Privacy Policy published on the Website.
15.2. The Company may collect anonymized usage statistics to improve the Service.
16.1. The Company has the right to unilaterally amend these Terms at any time.
16.2. Changes take effect upon publication of the new version of the Terms on the Website, unless otherwise stated in the publication itself.
16.3. Continued use of the Service after the Terms are amended constitutes the User's acceptance of the new version.
All disputes, claims, or disagreements arising from or in connection with these Terms of Use are governed by the laws of Germany, without regard to its conflict of law principles. The User agrees to the exclusive jurisdiction of the courts of Munich (Landgericht München) for the resolution of any such disputes.
These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and SoulDestiny regarding the use of the service and supersede all prior or contemporaneous oral or written agreements regarding the subject matter hereof.
SoulDestiny shall not be liable for any inability or delay in fulfilling its obligations under these Terms if such inability or delay is caused by events beyond SoulDestiny's reasonable control, including but not limited to natural disasters, wars, terrorism, civil unrest, embargoes, actions of civil or military authorities, fires, floods, accidents, network or internet outages, shortages of vehicles, fuel, energy, labor, or materials.
